National Child Redress Scheme Update: August 2019  

We are pleased to announce that ACS Mutual has been accepted and recognised as a Participating Group under the National Redress Scheme for Institutional Child Abuse Act 2018. This means we are authorised to provide ACS Mutual members with the ability to opt-in to the National Child Redress Scheme with minimum risk, cost and effort, and to provide financial protection from any Redress claims your organisation may face. 

Shortly we will begin the process of onboarding for ACS Mutual members who wish to join the Scheme.  

“Redress” means to remedy or set right an unfair situation, and the use of the word is a helpful reminder of our role.

We strongly urge you to opt into the Redress Scheme, to join the Church in righting the wrongs of the past and rebuilding trust with those affected by Institutional child abuse.   

It is a widely held expectation of our communities and of government to see all our churches opt-in and in turn send a strong message of support as part of a national response to survivors of child sexual abuse.

Most of our churches will not have any claims, however, our 25 years of experience in Church and Ministry insurance can attest to the fact that sometimes historical matters can come to the fore, which have been previously unknown. 

Opting in to the National Redress Scheme via the ACS Mutual Participating Group will ensure these potential situations are protected.   

In the next few weeks we will launch our National Redress Portal, through which, your organisation will be able to indicate your intention to opt-in to the Scheme.  ACS Mutual have sought to simplify the onboarding process as much as possible, utilising information we already have on file about your organisation. We will however, require your co-operation in providing additional information to satisfy the onboarding process. 

In preparation, we have compiled a checklist below outlining the additional information you will need to provide as part of the onboarding process. 

Please note that the information we are asking you to gather now in preparation for the onboarding process will need to be entered into the National Redress Portal and not sent to us separately. You will receive a link to the National Redress Portal in the next few weeks.  

Once you elect to opt-in to Redress as a member of ACS Mutual, claims which may be lodged against your organisation via the Redress Scheme will be paid by the ACS Mutual Participating Group on behalf of your organisation.

Claim payments will be subject to an excess which your organisation will contribute to the overall settlement.  At no time will an organisation be directly liable for any Redress payments whilst you are a member of the ACS Mutual Participating Group.

This unique protection is afforded only to our Mutual members, and effectively eliminates direct financial burden on your organisation which may result from a Redress claim.  

ACS Mutual will charge a reasonable annual levy rate for each participating member based on the size of your organisation.  You will be provided with a quotation of your costs as part of the online opt in process which will be emailed to you in coming weeks.   


What Will You Need To Do To Prepare?  

  1. Nominate and identify the person/persons who will be responsible for completing the onboarding declaration and to act as the authorised contact point for any matters which may arise (N.B Some company structures may require more than one authorised executive to sign). 
  2. Ensure that company details (including ABN, ACN, business registrations etc) are up to date.This can be done simply by logging in to the ASIC website (https://asic.gov.au/) using your ASIC Connect username and password.  
  3. Compile a list of all legal names (including trading names) that your organisation may have been known by, including historical entities linked to your organisation. 
  4. Detail any past incidents which may result in a Redress claim (NB. Redress claims can only be made for incidents which occurred prior to 1 July 2018) 
  5. For organisations with membership in excess of 500 people per week, denominational head offices, schools, or entities who have past incidents which may give rise to a claim we would strongly recommend registering your organisation on the Department of Human Services Provider Digital Access (PRODA) site.  For more information and assistance to authenticate with PRODA please refer to www.humanservices.gov.au/proda  

To ensure the smooth running of any redress claims it is crucial that correct information is gathered.  This will ensure that potential claimants are able to easily identify organisations via the Redress Scheme website. In some cases, claims may need to be expedited making responses time critical.
